Welcome to Cartoos Car World. These Terms of Service (“Terms”) govern your access to and use of our website www.cartooscarworld.com and all related services, including the purchase of off-roading gears, flood lights, spot lights, and accessories from brands such as Stedi, Kings, and Lightforce (collectively, the “Services”).
By accessing, browsing, or using the Website or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Shipping & Pickup Policy, Privacy Policy, and any other policies referenced herein. If you do not agree with any part of these Terms, you must not use the Website or our Services.
These Terms constitute a legally binding electronic contract under the Information Technology Act, 2000, Indian Contract Act, 1872, and other applicable Indian laws.
1. Eligibility
• You must be at least 18 years old or the age of majority in your jurisdiction to use the Website and place orders.
• By using the Services, you represent and warrant that you have the legal capacity to enter into these Terms and comply with all applicable laws.
2. User Account (If Applicable)
• Certain features may require creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
• Notify us immediately of any unauthorized use.
• We reserve the right to suspend or terminate accounts for any violation of these Terms.
3. Products and Orders
• All products are subject to availability. We reserve the right to discontinue or modify any product without notice.
• Product descriptions, images, specifications, and pricing are provided in good faith but may contain errors. We are not liable for typographical or photographic errors.
• Orders are offers to purchase; we accept them only upon confirmation (e.g., order confirmation email).
• We reserve the right to refuse or cancel any order for reasons including suspected fraud, pricing errors, unavailability, or legal restrictions.
4. Pricing and Payment
• All prices are in Indian Rupees (₹) and inclusive of applicable taxes unless stated otherwise.
• Shipping charges (for India-wide delivery) are additional and displayed at checkout.
• Payments are processed securely via Razorpay or UPI. All payments are prepaid for shipped orders.
• We do not store your payment card details.
5. Shipping, Delivery, and Pickup
• Refer to our separate Shipping & Pickup Policy (incorporated herein by reference) for detailed terms on pickup (Punjab only), India-wide shipping, timelines (3–5 business days for pickup readiness; up to 10 business days for delivery), tracking, and related matters.
• Risk of loss passes to you upon handover to the courier (for shipped orders) or upon pickup.
6. Warranty, Returns, Refunds, and Exchanges
• All products carry a 5-year manufacturer’s warranty against manufacturing defects, as detailed in our Shipping & Pickup Policy.
• All sales are final. No returns or cancellations for change of mind, incorrect selection, or similar reasons.
• Returns accepted only for:
• Manufacturing defects or malfunction (within warranty period).
• Transit damage (reported with photos within 48 hours of receipt).
• Process: Raise a support ticket with proof (invoice, photos/videos). Approved claims result in repair/replacement only (no cash refunds unless required by law). Return shipping may be at your cost unless transit damage is proven.
• We are not liable for misuse, improper installation, accidents, or normal wear and tear.
7. Intellectual Property
• The Website, content, logos, trademarks, product images, and all materials are owned by us or our licensors and protected under Indian copyright, trademark, and other intellectual property laws.
• You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent.
8. User Conduct
• You agree not to:
• Use the Website for unlawful purposes.
• Transmit viruses, malware, or harmful code.
• Interfere with the Website’s functionality.
• Post false reviews or engage in fraudulent activity.
• We may remove content or terminate access for violations.
9. Limitation of Liability
• To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Website or Services.
• Our total liability shall not exceed the amount paid by you for the product in question.
• We provide no warranties beyond those expressly stated (products sold “as is” except for the 5-year warranty).
10. Indemnification
• You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, costs, and expenses (including legal fees) arising from your breach of these Terms, misuse of the Services, or violation of any third-party rights or laws.
11. Force Majeure
• We are not liable for failure or delay in performance due to events beyond our reasonable control (e.g., acts of God, war, strikes, pandemics, government actions, courier disruptions).
12. Governing Law and Dispute Resolution
• These Terms are governed by the laws of India, without regard to conflict of law principles.
• Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Ludhiana, Punjab.
• We encourage informal resolution first—contact support before legal action.
13. Changes to Terms
• We may update these Terms at any time. Changes will be posted on the Website with the updated “Last Updated” date.
• Your continued use after changes constitutes acceptance. Review periodically.
14. Severability
• If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
15. Entire Agreement
• These Terms (together with the Shipping & Pickup Policy, Privacy Policy, and order confirmations) constitute the entire agreement between you and us.
